What is Workers' Compensation?

Workers' compensation covers workers for work-related accidents and illnesses. Corporations, partnerships, LLCs, LLPs and sole proprietorships must have coverage if they have employees.

Corporations without employees:
May elect not to have WC coverage if firm is limited to one or two officers and the officer(s) choose to exclude themselves.
Partnerships without employees:
May elect not to have WC coverage if partners choose to exclude themselves.
Sole Proprietorships:
Not subject to the law, but may elect to be subject to the law.

What does Workers' Compensation cost?

Workers' Comp rates are statutory so all insurers must use the rates promulgated by the state. Experience has shown that architects and engineers are generally safer firms when compared with firms involved in manufacturing, industrial and other industries.

Corporations, Partnerships, LLCs, LLPs and Sole Proprietorships must have coverage if they have employees.
Corporations:
All corporations must maintain WC coverage and the policy must cover officers as well as employees.
Partnerships and Sole Proprietorships: Partners and Sole Proprietors may have WC coverage on themselves, and must have coverage for their employees. Historically, partners and sole proprietors had been prohibited from maintaining WC on themselves. However Chapter 383, PL of 1999 effective April 13, 2000 permits proprietors and partners to be eligible. Election for coverage must be made at the time the policy is purchased or renewed and must be effective at the inception date of the policy. Election of coverage must apply to all of the partners.
Limited Liability Partnerships and Limited Liability Companies:
Partners of LLPs and Members of LLCs may have WC coverage on themselves, and must have coverage for their employees.
